✧TERMS OF SERVICE✧

This agreement is between myself, Bibsuki, the "Artist", and you, the "Client".
Failure to comply with these Terms of Service may result in being blacklisted from future commissions.I, the Artist, am not responsible if the Client fails to read or confirm these Terms of Service.
The Client is responsible for clarifying any unclear policies before commissioning.✧━━━ GENERAL TERMS ━━━✧
✦ Clients must NOT claim the commissioned artwork as their own creation.
✦ Clients must NOT edit, trace, or modify my artwork without my permission.
✦ My artwork may NOT be used for AI training, AI-generated works, NFTs, or cryptocurrency-related projects.
✦ Clients may share or repost the commissioned artwork for personal or social media use, as long as proper credit is given to to @Bibsuki (tagged or linked).✧━━━ COMMISSIONS ━━━✧
✦ Queue list is available here
✦ Commissions are personal use by default.
✦ I have the right to decline or cancel any commission for any reason.
✦ I work based on the queue line or closest deadline.
✦ All commissions are delivered digitally.
✦ The responsibility lies with the client to ensure that the order contains all necessary details and specifications.
✦ I am not responsible for any unsatisfactory element of the finished design if no feedback is provided for amendments during the creation process.
✦ Emotes are not guaranteed to be accepted on streaming platforms. If an emote designed by me is denied or reported, revisions will not be free of cost.✧━━━ COMMISSION PROCESS & REVISIONS ━━━✧
✦ Sketch, major revisions or concept changes must be requested during this stage.
✦ Lineart & Base Color, minor revisions are acceptable
✦ Rendering & Finalization, no revisions will be accepted✦ Major revisions include (but are not limited to):
━━━✧ Changing the overall concept or pose
━━━✧ Major composition changes
━━━✧ Redesigning characters or outfits
━━━✧ Adding additional characters or complex elements✦ Minor revisions include (but are not limited to):
━━━✧ Adjusting base colors (hair, skin, eyes, etc.)
━━━✧ Small visual tweaks
━━━✧ Minor text changes (for panels or graphic elements)✧━━━ PAYMENT POLICY ━━━✧
✦ Payment will only be requested after both parties have agreed on the details of the commission.
✦ Payment must be completed within 24 hours after the invoice is issued. Failure to pay within this timeframe may result in automatic cancellation of the commission slot. Repeated cases of reserving a slot and failing to pay may result in blacklisting.
✦ Payments are accepted through:
━━━✧ GCash for local Filipino clients
━━━✧ Gank for international clients
━━━✧ If an international client is able to pay through GCash, local pricing may be applied.
✦ Clients are required to pay a deposit amount equal to 50% of the total cost of commissioned items, whether placing a single order or multiple orders. The deposit serves as a commitment to proceed with the commissioned item(s). It is non-refundable and will be applied towards the total cost of the entire order.
✦ The commissioned items will be completed and delivered once the full payment is received.✧━━━ RUSHED COMMISSION FEE ━━━✧
✦ Additional fee for 50%-100% of the total commission cost
✦ Turnaround Time (TAT) begins when your commission reaches the top of the queue — not at the time of payment.
✦ Rush commissions must be discussed and approved before the commission begins.✧━━━ PRIVATE COMMISSIONS ━━━✧
✦ Additional fee for 50% of the total commission cost
✦ Private commissions may include one or more of the following conditions:
━━━✧The commission process cannot be shown on stream or social media
━━━✧ The final artwork cannot be posted publicly for 30 days after completion or
━━━✧ The final artwork cannot be publicly posted at any time✧━━━ COMMERCIAL MERCHANDISING ━━━✧
✦ Additional fee for 150% of the total commission cost
✦ This applies when the artwork is intended for mass production or direct sales, including (but is not limited to):
━━━✧ Printing the artwork for sale
━━━✧ Merchandise design (stickers, apparel, keychains, etc.)
━━━✧ Any product intended for resale
✦ Clients are responsible for clearly communicating the intended scope of commercial use, ensuring accurate pricing and agreement terms.✧━━━ MONETIZED CONTENT ━━━✧
✦ Additional fee for 50% of the total commission cost
✦ This includes (but is not limited to):
━━━✧ Monetized videos
━━━✧ Music videos
━━━✧ Marketing or promotional content
━━━✧ Other digital content intended to generate profit
✦ This fee does not apply to stream overlays or video thumbnails.REFUNDS & CANCELLATIONS
✦ If at any point you choose to cancel the contract or forfeit the work done so far, any payments already made are non-refundable.
✦ Refunds will only be issued under the following circumstances:
━━━✧ The Artist cancels the commission or is unable to complete the work.
━━━✧ The commission has not been started within 6 months after payment.
✦ If at any point the you fail to respond to sketches or status updates for a period of longer than 30 working days, this contract may be rendered void and further work will require renegotiation. Your position on the waitlist will be pushed to the bottom.
